Terms & Conditions

Important – These Terms form a legally‑binding agreement between you (“you”, “User”) and Erman Akar(“InstaInsight”, “we”, “us”). By downloading or using the InstaInsight mobile application (the “Service”), you agree to be bound by these Terms. If you do not agree, do not use the Service.

1 · Eligibility

You must be at least 16 years old (or older where required by local law) and capable of forming a contract to use the Service. If you are under 16 you must obtain parental or guardian consent before use.
The Service works with anonymous identifiers only; no account or login is required.
We may suspend or terminate access for any User who violates these Terms or applicable laws.

2 · What the Service Does

InstaInsight provides analytics, insights, and posting‑time recommendations for public Instagram™ accounts. We obtain publicly available data through:

Apify Technologies s.r.o. scraped datasets (subject to the Apify General Terms and Conditions); and
OpenAI L.L.C. language‑model APIs (subject to the OpenAI Service Terms) to generate AI‑powered analysis.

The Service is not endorsed by, or affiliated with, Meta Platforms Inc., OpenAI L.L.C., or Apify Technologies s.r.o.

3 · Third‑Party Terms You Also Agree To

Your use of AI‑generated output is subject to OpenAI’s Usage Policies and content limits. Retrieval of Instagram content is subject to Instagram’s Platform Terms. By using the Service, you agree to comply with those third‑party terms in addition to ours and accept that any scraping‑related risk rests with you.

4 · Credits & Usage

The Service operates on a daily credit allocation, refreshed automatically at 10 : 00 a.m. CET.
One credit is consumed each time you request fresh profile data or AI insights.
Credits are free and reset daily; no payment is currently required.
We may adjust daily credit limits with 30 days’ notice.
Service continuity disclaimer. While we endeavour to keep the credit system running, we reserve the right to suspend, reduce, or discontinue credits—or the entire Service—at any time for business, technical, or legal reasons. If we later charge for credits and subsequently discontinue them, any statutory refund rights apply; otherwise unused credits expire without compensation and without further liability on our part.

5 · Data We Process

All transfers use TLS 1.2+ and Firebase encryption at rest.

6 · Your Privacy Rights & Data Deletion

No direct personal identifiers – we do not collect names, emails, or passwords.
Access – you can view your search history in‑app.
Deletion – tap “Delete My Data” in settings to erase all stored usage and generated data instantly. This action is irreversible.
We act as Controller for anonymous usage analytics and as Processor for analysed Instagram content.

7 · User Content & Acceptable Use

Do not use the Service to analyse private Instagram accounts or unlawful content.
Automated or excessive use that degrades Service availability is prohibited.
You must respect all intellectual‑property and privacy rights when sharing outputs.

8 · Intellectual Property

All software, algorithms, UI assets, and analysis methodologies are owned by Erman Akar or his licensors. No rights are granted except as expressly stated here.

9 · Warranty Disclaimer & Limitation of Liability

The Service is provided “as is” and “as available.” We do not guarantee accuracy or uninterrupted availability. Because the Service is free, our total liability is limited to EUR 50, except nothing limits liability for intent, gross negligence, or injury to life, body, or health, or any liability that cannot legally be excluded.

10 · Indemnification

You agree to indemnify and hold InstaInsight (Erman Akar) harmless from any claim arising out of (a) your breach of these Terms, (b) your violation of OpenAI or Apify policies, or (c) your infringement of any third‑party right.

11 · Term & Termination

Either party may terminate at any time. Upon termination your licence to use the Service ends and we will delete stored usage data in accordance with Section 6.

12 · Changes to These Terms

We may update these Terms periodically. Material changes will be posted in‑app at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.

13 · Governing Law & Dispute Resolution

These Terms are governed by German law. For EU consumers: disputes may be brought in the courts of your country of residence. For business users: exclusive venue is Düsseldorf.
